In short. These terms cover our public website — the marketing pages, the blog, free tools and previews. If you subscribe to Bidwhistle, our Terms of Service govern the Service itself and come first.

1. About these terms

1.1 What they cover. Your use of https://www.bidwhistle.com and its public pages: marketing and pricing pages, the blog, enquiry, demo and newsletter forms, and any free tools, previews or sample data we publish there.

1.2 What they do not cover. The subscription Service, which is governed by our Terms of Service and the rest of the Agreement. Those prevail over these terms to the extent of any conflict.

1.3 Accepting them. By using the website you accept these terms. If you do not accept them, please do not use it.

1.4 Related documents. Our Privacy Notice, Cookie Notice and Complaints Policy.

2. Who we are

That registered office is a service address provided by the company administration provider we use, not premises we occupy.

“We”, “us” and “our” mean Bidwhistle OÜ. “You” and “your” mean the person using the website.

3. Using the website

3.1 Permitted use. You may browse the website and use its public features for your own personal or internal business purposes, lawfully and in line with these terms.

3.2 No scraping or bulk extraction. You must not scrape, crawl, spider, harvest, index for republication or bulk-extract any part of the website or its content, by automated or non-automated means — manual bulk copying counts. We reserve our rights under Article 4(3) of Directive (EU) 2019/790, so commercial text and data mining of this website needs our written consent.

3.3 No interference. You must not introduce malware, overload or degrade the website, circumvent rate limits or access controls, or carry out security testing without our prior written permission.

3.4 No unauthorised access. You must not access, or try to access, any non-public area of the website, any account that is not yours, or any connected system. If you find a vulnerability, tell us at security@bidwhistle.com and give us a reasonable chance to fix it before telling anyone else.

3.5 If you break these rules. We may block access, remove content and take legal action. Where it is practicable and lawful we will tell you first.

4. Our intellectual property and your licence

4.1 What we own. We or our licensors own the website and everything in it — text, design, layout, graphics, software, databases, and the Bidwhistle name and logo. Nothing here transfers any of it to you.

4.2 Your licence. You may view the website, and download or print reasonable extracts, for your own personal or internal business use, provided you keep any copyright and attribution notices intact and do not alter the material. Any other use needs our written consent.

4.3 Trade marks and third-party material. Bidwhistle, Olivia and our logo are our marks; please do not use them in a way that suggests we endorse you. Some content belongs to other people — section 7 explains the licences that apply to public procurement information.

5. Content you submit

5.1 What this covers. Anything you send us through the website — comments where we invite them, enquiry and demo request forms, newsletter sign-ups, survey answers and messages.

5.2 You keep your rights. You keep ownership of what you send. You give us a non-exclusive, royalty-free licence to store, copy and use it only for the purpose you sent it for — answering your enquiry, publishing your comment on the page that invited it, sending the newsletter you asked for — plus what we need for our records, security and legal obligations. We claim no wider licence, and we do not treat what you send us as automatically non-confidential or free for us to use as we like.

5.3 Your promise to us. You confirm that what you send is yours to send and that it does not infringe anyone’s rights, break the law, or mislead.

5.4 Please do not send confidential information through public forms. A comment on a public page is public, and our web forms are convenient rather than secure. If you need to send us something confidential or sensitive, email legal@bidwhistle.com first and we will agree a suitable route.

5.5 Moderation. We may edit, refuse or remove submissions — spam, abuse or material that infringes someone’s rights, for example. We do not pre-screen everything and are not obliged to monitor.

5.6 Personal data and feedback. What we do with the personal data in your submission is explained in our Privacy Notice. If you send suggestions about the Service, our Terms of Service explain how we treat them.

6. Free tools, previews and sample data

6.1 What they are. We may publish free search previews, sample tender data, calculators or similar tools. They are a taster of the Service: limited in scope, in volume and in how current they are.

6.2 “As is”. They are provided “as is” and free of charge, are not covered by our Service Level Agreement, and we may change, limit or withdraw any of them at any time without notice.

6.3 Fair use, and verify before you act. Use them as intended and within any published limits, not as a source for bulk extraction (clause 3.2). Sections 7 and 8 apply to them in full.

7. Public procurement information shown on the website

7.1 Where it comes from. Official and public procurement sources: in the UK, the Find a Tender Service, Contracts Finder, Public Contracts Scotland, Sell2Wales, ProContract and local authority contract registers; for the EU, Tenders Electronic Daily (TED); and national public procurement portals in Ireland, France, Spain, Germany, the Netherlands, Portugal, Poland, Finland, Austria, Estonia, Latvia, Denmark, Luxembourg, Hungary, Greece, Malta, the Czech Republic, Romania, Slovenia and Italy. The Privacy Notice (clause 4.4) lists each one.

7.2 Accuracy — please read this carefully.

• The website and its content are provided “as is” and we do not warrant that they will be uninterrupted, timely, secure or error-free.
• Procurement information comes from public sources we do not control. It may be incomplete, delayed, wrong, withdrawn or superseded. Only the notice published by the contracting authority — or, for the EU, the electronically signed notice in the Supplement to the Official Journal of the European Union — is authoritative. You must verify every material fact against the original before acting on it.
• We do not give refunds or credits for claimed inaccuracies in procurement information.

7.3 Attribution and non-endorsement.

• UK procurement information contains public sector information licensed under the Open Government Licence v3.0, © Crown copyright.
• EU procurement information is © European Union, 1998–2026, reused under Commission Decision 2011/833/EU.
• Notices on the UK Find a Tender Service may carry a nested European Union credit; where they do, (b) applies to that content too.
• Our reuse does not imply endorsement by the Publications Office of the European Union, the European Commission or any UK or other public body. We do not use their logos, emblems or trade marks.
• If you reproduce this information as clause 4.2 allows, keep these attributions with it.

7.4 If you are named in a notice. Our Privacy Notice has a section for people named in public procurement notices, explaining what we hold, why, and how to object.

8. No advice

8.1 We do not give advice. Nothing on the website is legal, procurement, bid-writing, tax, financial or eligibility advice, and nothing creates a professional or advisory relationship between us.

8.2 No guaranteed outcome. Nothing on the website is a promise that you will find, be eligible for, bid successfully for or win any contract, framework place or tender.

8.3 Get proper advice. Where a decision matters, take professional advice and read the original notice.

9. AI-generated content on the website

9.1 We say when content is AI-generated. Where a summary, description, translation or other item on the website was generated or materially assisted by AI, we label it on the page.

9.2 It can be wrong. AI-generated content can be inaccurate, incomplete or out of date. Sections 7.2 and 8 apply to it in full — check it against the original notice.

9.3 Machine-readable marking. Under Article 50 of the EU AI Act we will mark synthetic content in a machine-readable format so that it is detectable as artificially generated.

9.4 Olivia. Where Olivia, our AI assistant with a synthetic voice and animated avatar, is available on the website, you are told you are interacting with an AI system at the start of the interaction. Our AI Use Disclosure has the detail.

10. Links to and from the website

10.1 Links we publish. We link to other websites, including the source procurement portals. We do not control or endorse them and are not responsible for their content, availability or how they handle your data; their own terms and privacy notices apply.

10.2 Linking to us. You may link to our home page or to a public page, fairly and lawfully, in a way that does not damage our reputation or suggest an association that does not exist. Do not frame our pages or present our content as your own. If we ask you to remove a link, please remove it.

11. Disclaimers and limitation of liability for website use

11.1 The website is free. We provide it free of charge and “as is”. To the fullest extent the law allows, and subject to clause 11.4, we exclude the warranties, conditions and terms implied by law about the website and its content.

11.2 Losses we exclude. Subject to clause 11.4, we are not liable for indirect or consequential loss; loss of profits, revenue, business or anticipated savings; loss of goodwill; or loss of opportunity — including any tender, bid, framework place or contract you did not find, found late, did not bid for or did not win.

11.3 The cap. Subject to clause 11.4, our total liability arising out of your use of the website is limited to the greater of (a) €500 and (b) the total Fees you paid us in the 12 months before the event giving rise to the claim.

11.4 What is never excluded or limited. Nothing here excludes or limits our liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; intentional breach (§ 106 of the Estonian Law of Obligations Act does not allow that to be excluded) and gross negligence; or anything else that cannot lawfully be excluded, including a consumer’s statutory rights.

11.5 Your responsibility. You are responsible for your own device, software, internet access and virus protection.

12. Privacy and cookies

12.1 Personal data. Our Privacy Notice explains what personal data we collect through the website, why, on what legal basis, how long we keep it and what rights you have.

12.2 Cookies. Our Cookie Notice lists the cookies and similar technologies we use. We ask for consent before setting anything that is not strictly necessary, we never use a cookie wall, and you can change your choices at any time from the “Cookie Preferences” button at the bottom of every page.

13. Availability of the website

13.1 No guarantee. We do not promise the website will always be available or uninterrupted. We may suspend, withdraw or restrict all or part of it for business or operational reasons, giving notice where we reasonably can.

13.2 The Service is different. The uptime targets in our Service Level Agreement apply to the subscription Service, not to the public website, free tools or previews.

14. Governing law and jurisdiction

14.1 Governing law. These terms, and any dispute or claim arising out of or in connection with them (including non-contractual ones), are governed by the laws of Estonia.

14.2 Jurisdiction. Subject to clause 14.3, the courts of Estonia have exclusive jurisdiction and Harju County Court (Harju Maakohus) is the court of first instance.

14.3 If you are a consumer. Nothing in clauses 14.1 or 14.2 deprives you of the protection of the mandatory law of the country where you are habitually resident. You may sue us in the courts of your country of residence as well as in Estonia, and we will bring proceedings against you only in the courts of your country of residence.

14.4 Let us know first. If something has gone wrong, tell us at legal@bidwhistle.com or use our Complaints Policy before going to court — it is usually quicker for both of us.

15. Changes to these terms

15.1 We may update these terms — for example when we add a feature or the law changes. The dates at the top tell you which version you are reading, and the version in force when you used the website is the one that applies to that use. The current version is always at Website Terms of Use.
